INTRODUCTION
Newcastle Occupational Health & Hygiene Ltd.
specialises in all aspects of occupational health
and hygiene, environmental monitoring, noise
control and food hygiene. We maintain an inhouse staff of professionally qualified
physicians, nurses, hygienists and
environmental health advisers to liaise with
clients and deal with all areas of health and
hygiene in the workplace and the environment.
APPOINTING Newcastle Occupational Health
& Hygiene Ltd.
Newcastle Occupational Health & Hygiene Ltd.
is normally appointed to service the client’s
needs following acceptance of a verbal or
written quotation. The appointment will normally
be confirmed in writing.
To terminate the appointment, one month’s
notice by either party should be given to allow
sufficient time for alternative arrangements to be
made and contracts with suppliers to be
cancelled. Exceptions to this are ongoing
contracts which require six months’ notice of
cancellation.
STANDARD CONDITIONS OF CONTRACT
1. Price Variation
Quotations, when submitted, are normally valid
for thirty days. Thereafter, any price increases
suffered by Newcastle Occupational Health &
Hygiene Ltd. will be passed onto the client. Any
delay in placing a contract after one month may
invalidate the quoted price. A revised quotation
will be submitted only if requested.
2. Tax
All quotations are normally submitted exclusive
of VAT. VAT, where applicable, will be charged
at the prevailing rate at the time of invoice.
3. Preliminary Work
Quotations, when submitted, unless otherwise
stated do not include the cost of any preliminary
work such as initial discussions, site visits and
preliminary assessments. These are charged
extra. A quotation for such work can be given if
requested prior to commencing the work.
All work carried out, whether experimentally or
otherwise, at a client’s request, will be charged
unless a written agreement to the contrary has
been given.
A charge may be made to cover any additional
work involved where information or materials
provided by a client are not adequate for the
purpose for which they are provided, or where
such information/materials has to be obtained
by Newcastle Occupational Health & Hygiene
Ltd. on a client’s behalf from alternative sources.
“Adequate” will be determined by Newcastle
Occupational Health & Hygiene Ltd.
4. Delivery
Quotations submitted are on the understanding
that delivery will be made to the client’s address.
A charge may be made to cover any extra costs
involved for delivery to more than one address
or a different location.
Should urgent delivery be requested, any extra
charge for transport or overtime worked will be
invoiced to the client.
5. Claims
Newcastle Occupational Health & Hygiene Ltd.
shall not be liable in respect of any claim unless
the client advises of any damage, quality,
inaccuracy, delay or loss of goods in transit
within one week of delivery.
6. Terms of Payment
All quotations are submitted net. Invoices are
submitted on completion of the work and are
due for payment within thirty days from the date
of the invoice.
Large value jobs, spanning several
weeks’/months’ work, may be invoiced in two or
more instalments. Such arrangements will be
with the client’s agreement.
7. Force Majeure
Newcastle Occupational Health & Hygiene ltd.
shall be under no liability if they shall be unable
to carry out any provision of the contract for any
reason beyond their control including (without
limiting the foregoing) Act of God, legislation,
war, fire, flood, drought, strike or other action
taken by employees in contemplation or
furtherance of a dispute or owing to any liability
to procure materials required for the
performance of the contract. During the
continuance of such a contingency, the client
may by written notice to Newcastle
Occupational Health & Hygiene Ltd., elect to
terminate the contract and pay for work done
and materials used but subject thereto shall
otherwise accept delivery when available.
